1. Introduction

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Hypebuzz Events Limited ("Hypebuzz", "we", "us", or "our"), a company incorporated under the laws of the Republic of Kenya, operating the website https://hypebuzzke.com (the "Platform").

By accessing, browsing, or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and all applicable laws and regulations. If you do not agree to these Terms, you must immediately cease using the Platform.

2. Role of Hypebuzz

Hypebuzz operates as a ticketing and payment intermediary platform that facilitates the sale and distribution of event tickets on behalf of third-party event organizers ("Event Organisers").

We provide technology infrastructure and payment processing services but do not assume any responsibility for the quality, safety, legality, or any other aspect of the events themselves. Any disputes, claims, or issues arising from an event must be directed to the Event Organiser.

3. Tickets and Entry Rights

3.1 Valid Ticket Requirement

A valid ticket, properly purchased through the Platform and presented in the format specified by the Event Organiser (typically a QR code), is required for entry to any event.

3.2 Right of Refusal

Event Organisers and venue security personnel reserve the absolute right to refuse entry or remove any person from an event for any lawful reason, including but not limited to:

• Violation of venue rules or code of conduct
• Intoxication or disorderly behavior
• Security or safety concerns
• Invalid, fraudulent, or duplicate tickets
• Failure to comply with age restrictions
• Failure to present valid identification when required

3.3 No Refund for Entry Denial

No refunds will be issued if entry is denied for any of the reasons stated above or for any other reason deemed appropriate by the Event Organiser or venue security. Ticket purchases are final, subject to the Event Organiser's specific refund policy.

4. Fees and Refunds

4.1 Service Fees

Hypebuzz charges a service fee for processing ticket transactions. This fee is clearly displayed during the checkout process and is separate from the ticket price set by the Event Organiser.

4.2 Ticket Refunds

Refunds for ticket purchases (excluding service fees) are handled exclusively by Event Organisers according to their individual refund policies. Hypebuzz does not control or influence refund decisions.

To request a refund, you must contact the Event Organiser directly. Refund policies vary by event and may include circumstances such as event cancellation, significant changes to event details, or other conditions specified by the Event Organiser.

5. User Responsibilities and Acceptable Use

By using the Platform, you agree to:

• Provide accurate and complete information during ticket purchase
• Comply with all applicable laws and regulations
• Not engage in fraudulent activities, including the use of stolen payment methods
• Not resell tickets in violation of applicable laws or Event Organiser policies
• Not share, transfer, or duplicate tickets unless explicitly permitted
• Review and comply with individual Event Organiser terms and conditions

5.1 Acceptable Use Policy

You agree not to engage in any of the following prohibited activities:

• Unlawful or Fraudulent Activity: Using the Platform for any illegal purposes, fraud, money laundering, or any activity that violates Kenyan law or international regulations
• System Interference: Attempting to interfere with, compromise, or disrupt the integrity, security, or proper functioning of the Platform, including but not limited to:
  • Unauthorized access to systems or networks
  • Introduction of viruses, malware, or malicious code
  • Denial of service attacks or similar activities
  • Circumventing security measures or authentication mechanisms
• Automated Abuse: Using automated systems, bots, scrapers, or similar technologies to access, monitor, copy, or extract data from the Platform without our express written permission
• Account Abuse: Creating multiple accounts, sharing accounts, or using accounts for purposes other than intended
• Content Violations: Posting, transmitting, or sharing content that is defamatory, obscene, threatening, or violates intellectual property rights

6. Limitation of Liability

6.1 Scope of Liability

To the maximum extent permitted by the laws of the Republic of Kenya, Hypebuzz, its directors, officers, employees, agents, and affiliates shall not be liable for any:

• Indirect, incidental, special, or consequential damages arising from your use of the Platform or attendance at any event
• Loss of profits, revenue, data, or business opportunities
• Personal injury, property damage, or death occurring at events
• Event cancellations, postponements, or changes to event details
• Actions or omissions of Event Organisers, venue operators, or other third parties
• Technical issues, system failures, or interruptions in service
• Unauthorized access to your account or payment information

6.2 Maximum Liability

In any event, Hypebuzz's total aggregate liability to you for any claims arising from these Terms or your use of the Platform shall not exceed the total amount of service fees you paid to Hypebuzz in the twelve (12) months preceding the claim.

6.3 Platform Provided "As Is"

The Platform is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

7. Indemnification

You agree to indemnify, defend, and hold harmless Hypebuzz, its directors, officers, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from: (a) your use of the Platform; (b) your attendance at any event; (c) your violation of these Terms; or (d) your violation of any rights of another party.

8. Data Protection and Privacy

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Platform, you consent to our data practices as described in the Privacy Policy.

We comply with the Data Protection Act, 2019 of Kenya and other applicable data protection regulations.

9. Modifications to Terms

Hypebuzz reserves the right to modify these Terms at any time without prior notice. Changes will be effective immediately upon posting to the Platform. Your continued use of the Platform after any modifications constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

10. Governing Law and Dispute Resolution

10.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya, without regard to its conflict of law provisions.

10.2 Jurisdiction

Any disputes arising out of or relating to these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Kenya, and you consent to the personal jurisdiction of such courts.

10.3 Dispute Resolution

In the event of any dispute, you agree to first attempt to resolve the matter informally by contacting us directly. If the dispute cannot be resolved informally, you agree to submit to binding arbitration in accordance with the Arbitration Act, 1995 of Kenya, or such other dispute resolution mechanism as may be mutually agreed upon.

11. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if such modification is not possible, the provision shall be severed from these Terms. The remaining provisions shall continue in full force and effect.

12. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices or agreements published on the Platform, constitute the entire agreement between you and Hypebuzz concerning your use of the Platform and supersede all prior or contemporaneous communications and proposals, whether oral or written.
